These Terms of Sale ("Terms") govern all purchases made through Used Bulk Appliance Warehouse ("UBAW," "we," "us"). By placing an order, you agree to these Terms.
1. Wholesale Buyers Only
Our Wholesale Marketplace is intended for appliance dealers, repair shops, liquidators, and resellers purchasing for business purposes — not for individual consumers.
2. Product Condition
All appliances sold are haul-away (used) units, sold as-is with no warranties of any kind, express or implied. Haul-away appliances are untested and unfiltered; they may require repair, cleaning, or refurbishing before resale. Listings include descriptions, photos, and/or video to represent the actual condition of the load.
3. Pricing & Payment
All listings are sold at flat, posted prices — we do not run auctions. Full payment is due at the time of purchase via credit card or bank transfer (ACH). Orders are not released until payment is received in full.
4. Freight & Shipping
Freight charges are calculated separately from the appliance price and vary based on shipping origin (Morgantown, WV or Richmond, VA) and destination. Buyers may be responsible for arranging freight through UBAW or a designated freight partner, as specified at checkout. Estimated ship times vary by origin and are provided at the time of purchase.
5. Sales Tax
Applicable sales tax will be charged unless a valid resale certificate is provided prior to order fulfillment.
6. Holds & Availability
Listings are not held for any reason other than payment received. Availability is not guaranteed until payment is confirmed.
7. No Customization
Loads are sold as complete truckloads, as listed. Individual items within a load cannot be added, removed, or substituted.
8. All Sales Final
All sales are final. We do not offer refunds, returns, or exchanges once an order is placed and paid.
9. Receiving Your Shipment
- Freight carriers generally include a limited unload window (e.g. 2 hours); additional time may incur fees from the carrier.
- Match the truck seal to the Bill of Lading (BOL) before opening the truck. If the seal appears tampered with, contact us before opening the truck.
- Inspect items for shipping damage before unloading. Photograph and note any damage on the BOL while the shipment is still on the truck.
- Do not refuse a shipment unless the contents do not match your order.
10. Limitation of Liability
UBAW's liability for any claim related to a purchase is limited to the amount paid for the applicable order. We are not liable for indirect, incidental, or consequential damages.
11. Governing Law
These Terms are governed by the laws of the State of [West Virginia], without regard to conflict of law principles.
